Adjusting to the changes with marijuana laws

Laws concerning the decriminalization of marijuana are changing, and changing fast.

Livingston County State’s Attorney Seth Uphoff was a guest on a recent Community Forum and described the difficulties in the changing laws.

“There’s some dispute as to whether this is retroactive. So, for example, if you had a case that was pending, where you got caught with a small amount of cannabis, and it’s already been charged as a misdemeanor, you’ve been coming to court, you have an attorney and we’re getting ready for trial – does that stay as a misdemeanor or does this now become one of those civil law violations? Does it convert? Does the statute act retroactively and go back and catch those cases that are pending? And there’s still a legal dispute in that area that will have to be sorted out,” Uphoff said.
